These Terms & Conditions apply to all musical instruments hired from Booths Music. Please read them carefully before entering into an instrument hire agreement.

1. Introduction

These Terms & Conditions form the agreement between Booths Music (“Booths Music”, “we”, “our” or “us”) and the person or organisation hiring an instrument (“the Hirer”, “you” or “your”).

By completing an instrument hire agreement, either online or in store, you confirm that you have read, understood and accepted these Terms & Conditions.

This agreement applies to all instruments available through the Booths Music Instrument Hire service unless otherwise agreed in writing.

2. Definitions

For the purposes of this agreement:

Instrument means any musical instrument, together with any case, accessories, components or equipment supplied as part of the hire.

Hirer means the individual or organisation named on the hire agreement. Where the Hirer is acting for personal use rather than for a business, they will also benefit from any additional rights provided under applicable consumer legislation.

Booths Music means Booths Music, 17 Churchgate, Bolton, BL1 1HU.

Hire Agreement means the agreement entered into between Booths Music and the Hirer for the rental of an instrument under these Terms & Conditions.

3. Ownership

All instruments hired from Booths Music remain the property of Booths Music at all times.

Hiring an instrument does not transfer ownership or create any right to purchase the instrument unless a separate written agreement has been made.

The Hirer must not sell, lend, sub-hire, pledge, transfer or otherwise dispose of any hired instrument or allow ownership to pass to another person.

4. Nature of this Agreement

This agreement relates solely to the hire of musical instruments.

It is not:

a Hire Purchase Agreement;
a Conditional Sale Agreement;
a Consumer Credit Agreement; or
any other agreement that transfers ownership of the instrument.

The instrument remains the property of Booths Music throughout the hire period.

5. Consumer Rights

Nothing within these Terms & Conditions is intended to remove or reduce any statutory rights available under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or any other applicable legislation.

Where these Terms & Conditions differ from your statutory rights as a consumer, your statutory rights will always take precedence.

6. Eligibility to Hire

To hire an instrument from Booths Music:

You must be at least 18 years of age, or
the agreement must be completed and signed by a parent or legal guardian acting on behalf of someone under 18.

Booths Music reserves the right to request photographic identification and proof of address before completing any hire agreement.

We may decline an application for instrument hire where suitable identification cannot be provided or where we reasonably believe the hire cannot proceed safely or responsibly.

7. Instrument Condition

Before an instrument is hired, Booths Music will inspect and prepare it to ensure it is in good playing condition.

Where appropriate, a record of the instrument’s condition, serial number and any existing cosmetic marks may be made before collection.

The Hirer should inspect the instrument upon collection and notify Booths Music of any concerns, missing accessories or damage as soon as reasonably possible, and no later than 24 hours after receiving the instrument.

If no concerns are reported within this period, the instrument will be considered to have been accepted in satisfactory condition.

8. Types of Hire

Booths Music currently offers instruments on a rolling monthly hire basis.

All monthly hire agreements are subject to a minimum hire period of one calendar month.

After the initial month, the agreement will continue on a rolling monthly basis until the Hirer notifies Booths Music that they wish to end the hire and the instrument has been returned.

Booths Music may introduce additional hire options in the future. Where these apply, any specific terms will be explained at the time of hire.

9. Hire Period

The hire period begins on the day the instrument is collected from Booths Music or delivered to the agreed address.

The hire continues until the instrument has been returned to Booths Music, inspected and accepted by a member of staff.

Hire charges remain payable until the instrument has been returned, even if it is no longer being used.

10. Monthly Hire

Monthly hire charges are payable in advance.

The first month’s hire is payable before the instrument leaves Booths Music.

After the minimum hire period has ended, payments will continue monthly until the hire agreement is brought to an end in accordance with these Terms & Conditions.

Returning an instrument before the end of the minimum one-month hire period does not reduce or refund the first month’s hire charge.

11. Ending the Hire

The Hirer may end a monthly hire agreement at any time after the minimum hire period by contacting Booths Music by telephone, email or in person.

Hire charges will stop once:

Booths Music has been informed that the hire is ending;
the instrument has been returned; and
the instrument has been inspected and accepted by Booths Music.

If an instrument is returned before the end of the minimum hire period, the Hirer remains responsible for the full minimum hire charge.

12. Charges and Payments

Monthly hire charges are shown on our website and at the time of booking.

All hire charges are payable in advance.

Where applicable, a refundable security deposit will also be collected before the instrument is released.

Delivery charges, collection charges and any additional agreed services are separate from the hire charge unless otherwise stated.

Booths Music reserves the right to amend future hire charges. Where this affects an existing monthly hire agreement, we will provide at least one month’s notice before any change takes effect.

If the Hirer does not wish to continue at the revised rate, they may end the agreement before the new charges become effective by returning the instrument.

Failure to make payments when due may result in the suspension or termination of the hire agreement and Booths Music reserving the right to recover the instrument together with any outstanding hire charges.

13. Security Deposit

Some instruments require a refundable security deposit before hire begins.

The deposit is held as security against:

unpaid hire charges;
loss or theft;
accidental or deliberate damage beyond normal wear and tear;
missing accessories or components;
cleaning or repair costs where these arise from misuse; and
any reasonable administration or recovery costs resulting from a breach of this agreement.

The deposit is not an advance payment towards hire charges.

Once the instrument has been returned, inspected and all outstanding charges have been settled, Booths Music will normally refund the deposit within seven working days.

Where deductions are necessary, Booths Music will provide an explanation of the charges upon request.

14. Cancellation

If a hire has been arranged but the instrument has not yet been collected or dispatched, the Hirer should contact Booths Music as soon as possible if they wish to cancel.

Where a hire agreement has been entered into online, by telephone or away from our premises, consumers may have cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If the Hirer requests that the hire begins during the statutory cancellation period, they acknowledge that their right to cancel may be reduced or lost once the instrument has been collected or delivered.

Nothing in this section affects any statutory rights available to consumers.

15. Option to Purchase

Booths Music’s Instrument Hire service is intended as a rental scheme and does not automatically include an option to purchase.

From time to time, Booths Music may offer the opportunity to purchase a hired instrument or upgrade to a new instrument. Any such offer is entirely at Booths Music’s discretion and will be confirmed separately in writing.

Unless expressly agreed in writing, all hire payments are rental charges only and do not contribute towards the purchase price of an instrument.

16. Hirer’s Responsibilities

Throughout the hire period, the Hirer is responsible for taking reasonable care of the instrument and any accessories supplied with it.

The Hirer agrees to:

use the instrument only for its intended purpose;
keep the instrument clean, safe and securely stored when not in use;
protect the instrument from avoidable damage, excessive heat, damp or other unsuitable conditions;
ensure the instrument is transported safely using the supplied case where applicable;
return the instrument, together with all supplied accessories, in a clean and satisfactory condition, allowing for reasonable wear through normal use.

The instrument must not be:

sold, loaned, hired out or transferred to another person;
altered, modified or dismantled;
repaired by anyone other than Booths Music or a repairer authorised by Booths Music.

If the Hirer becomes aware of any fault or damage during the hire period, Booths Music should be contacted as soon as reasonably possible.

17. Insurance, Loss and Damage

Booths Music maintains appropriate business insurance for its own premises and business activities. This insurance does not remove the Hirer’s responsibility for the instrument while it is in their possession.

The Hirer is responsible for taking reasonable care of the instrument throughout the hire period and may be liable for the cost of repair or replacement where loss, theft or damage occurs beyond normal wear and tear.

If an instrument is lost, stolen or damaged, the Hirer must notify Booths Music as soon as reasonably practicable.

Where an instrument has been stolen, the Hirer should also report the incident to the Police and provide Booths Music with the relevant crime reference number.

Nothing in this agreement prevents the Hirer from arranging their own insurance should they wish to do so.

18. Repairs and Instrument Faults

Every instrument is inspected and prepared by Booths Music before it is hired.

If an instrument develops a fault through normal use during the hire period, the Hirer should contact Booths Music promptly. Wherever reasonably possible, we will inspect, repair or replace the instrument to minimise disruption.

The Hirer must not arrange repairs or authorise work to be carried out by a third party without the prior agreement of Booths Music.

Booths Music will not normally reimburse the cost of unauthorised repairs.

Where damage has resulted from misuse, neglect or accidental damage, the Hirer may be responsible for the reasonable cost of repair or replacement.

Nothing in this section affects any statutory rights available to consumers.

19. Returning the Instrument

At the end of the hire period, the instrument should be returned to Booths Music during normal opening hours unless another arrangement has been agreed.

The Hirer should ensure the instrument is returned:

together with its case and all supplied accessories;
in a clean condition;
adequately protected for transport;
with any keys, straps, mouthpieces, bows, cables or other items originally supplied.

Following its return, Booths Music will inspect the instrument to confirm its condition.

If the instrument is returned in satisfactory condition and all outstanding hire charges have been settled, any refundable security deposit will normally be returned within seven working days.

Where damage, missing items or outstanding charges are identified, Booths Music may make reasonable deductions from the security deposit in accordance with these Terms & Conditions.

20. Instrument Inspection and Preparation

Every instrument hired by Booths Music is inspected before it is issued to a customer.

Where necessary, instruments are serviced, adjusted, cleaned and tested to ensure they are in good playing condition before leaving the shop.

When an instrument is returned, it will be inspected again before being made available for future hire. Where appropriate, it may be cleaned, sanitised, repaired or serviced prior to its next hire.

This process helps us maintain the quality and reliability of our instrument hire service for all customers.

16. Hirer’s Responsibilities
